What Types of Compensation Can You Get in an Asbestos Lawsuit?

Previous Next

With help from an attorney, you may be able to receive compensation that covers the losses you have already suffered as well as any suffering you will likely endure in the future. Your settlement or jury award could include money for:

  • Medical bills: The cost of medication, surgery, chemotherapy, and other common cancer treatments can quickly add up—especially if you have an advanced or aggressive form of cancer that requires extensive treatment.
  • Loss of wages: You may have to take time away from work as you heal, undergo medical treatments, and try to recover from your illness.
  • Loss of earning capacity: Unlike the loss of wages, which is usually temporary, loss of earning capacity means you are no longer able to hold a full-time job or earn as much money as you did prior to developing cancer.

When you receive an asbestos cancer diagnosis, you could lose more than money. Your mental and physical well-being may also decline due to:

  • Pain and suffering: Asbestos-related cancers can cause breathing difficulties and other troublesome symptoms. The toll of prolonged physical pain can also wear on your mental health.
  • Disability: You may be unable to perform the full range of tasks that you did before. In some cases, you may need to have organs removed.
  • Reduced quality of life: Both cancer and cancer treatment can drastically reduce your ability to engage in your favorite pastimes or even take care of yourself without assistance.

Whatever impact that cancer has had on your life, it was unnecessary—if the liable party had behaved more carefully, you could have avoided your suffering. The team at Herschensohn Law can help you hold the liable party accountable for their irresponsibility.

When Should You File an Asbestos Cancer Case?

Previous Next

RCW § 4.16.080 states that anyone who wants compensation for asbestos-related cancer must file a case within three years of the date of diagnosis or discovery. Once the deadline passes, you are no longer entitled to compensation.

Determining if your case still falls within the statute of limitations can be particularly difficult in asbestos cases. Do you know when and where your exposure occurred? Can you name the person or company that neglected to warn you about the presence of asbestos?

Even if you do not know these answers, Herschensohn Law may be able to help you.

Why Is Asbestos Dangerous?

Previous Next

According to the National Cancer Institute, asbestos was once commonly used as insulation and to fireproof buildings. Its ubiquity is part of what makes it so dangerous: any older building you work in could contain asbestos.

Another danger is the nature of asbestos itself. Anyone who comes into regular, direct contact with asbestos risks inhaling small asbestos fibers. These fibers build up in the throat, chest, and/or lungs, causing breathing problems and other symptoms.

Asbestos exposure has been linked to various diseases (such as asbestosis) as well as numerous cancers, including:

  • Mesothelioma
  • Lung cancer
  • Ovarian cancer
  • Laryngeal cancer

Asbestos Cancer Can Be Deadly

If you have received a terminal diagnosis or lost a loved one to asbestos cancer, please accept our condolences.

In a situation like this, you may wonder if it is worth filing a lawsuit. What if you do not live long enough to finish your case? What is the point if money cannot bring your loved one back?

We believe that wrongful death cases serve an important purpose—they ensure the liable party does not get away with what they did to your family, and they provide you with financial support for the difficult days ahead. Our firm can assist you with your wrongful death case.

“Zach will always take time and give you quality advice that you can trust. Highly recommended!”
