Washington’s Dog Bite Law

Under RCW 16.08.040, dog owners in Washington face strict liability when their animal bites someone. The statute states: “The owner of any dog which shall bite any person while such person is in or on a public place or lawfully in or on a private place including the property of the owner of such dog, shall be liable for such damages as may be suffered by the person bitten, regardless of the former viciousness of such dog or the owner’s knowledge of such viciousness.”

What does that mean? You don’t need to prove the owner knew their dog was dangerous. The law protects you whether the attack happened in a park, on a sidewalk, or even on the owner’s property if you were lawfully present.

Exceptions exist. If you provoked the dog, were trespassing, or the bite involved a police dog performing official duties, the strict liability statute won’t apply. However, even if one of these defenses applies, you may still have a claim based on negligence.
