We Handle Both Personal Injury and Wrongful Death Cases
Do you still have the right to collect compensation if your loved one passes away in a hit and run accident? Yes, you do.
Our car accident attorneys can file a wrongful death lawsuit on your family’s behalf and pursue the compensation you need to:
- Cover your loved one’s end-of-life expenses
- Maintain your standard of living (if you relied on your loved one’s income to pay bills or support dependents)
- Ensure that you have the time and peace of mind to pick up the pieces and move on with your life
Every hit and run is a crime, but leaving the scene is especially immoral when the hit and run driver causes a fatal injury. Our team wants to make sure that you get what you deserve after such a tragic event, including:
- Fair compensation
- Justice for your loved one
- Compassionate legal counsel in your hour of need
Depending on how the car accident affected your life, you could be eligible for damages to cover your physical, mental, and financial losses. Answering the questions below can give you a better idea of what you may qualify for—and of course, the lawyers at Herschensohn Law will let you know for sure.
- Pain and suffering: Did your injuries cause you physical distress when they first occurred? Are you still experiencing symptoms? Has your mental health suffered because of the traumatic accident or your injuries?
- Diminished quality of life: Do your injuries make it harder or impossible for you to perform simple tasks like bathing or cooking? Have you had to give up certain activities?
- Loss of consortium: Has your relationship with your close relatives, particularly your spouse, deteriorated? Have you lost touch with anyone you were close to before the accident?
- Medical expenses: How much have you spent to treat your accident-related injuries or make it easier to live with those injuries? How much do you think you might spend in the future?
- Property damage: Did your car sustain any damage in the accident? Did you have to get it repaired, replace your vehicle, or rent a car?
- Loss of wages or earning capacity: Did you temporarily and/or permanently lose the ability to earn as much money as you did before?
These and other damages are available only for a limited time. RCW § 4.16.080 gives accident survivors three years to begin a case or they risk forfeiting their right to compensation.
To preserve your rights, we encourage you to take action while there is still time. The injury lawyers at Herschensohn Law can work quickly to file your case before the deadline runs out, as long as you give us enough time to do so.

According to RCW § 46.52.020, any driver who injures or kills a person with their car must stop as close to the accident scene as possible and take the following steps:
- Provide the victim with their contact and insurance information
- Show the victim their driver’s license
- Get the victim to a hospital or another medical facility if necessary
Fleeing the accident scene without performing these tasks constitutes a hit and run. Any driver caught committing this crime could be subject to legal penalties, such as a fine and/or a prison sentence.
The hit and run driver could also have to pay compensation directly to anyone they injured or the relatives of anyone they killed. Our team can help you hold the reckless driver accountable by fighting for the money—and, by extension, the justice—your family deserves.
